The petitioner apprehends his arrest in connection with Gaighat P.S. Case No. 54 of 2017 registered under Sections 272, 273, 120(B) of the Indian Penal Code and section 30(A), 35(A), 38, 41 of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He is innocent and has falsely been implicated in the present case. Further submission is that on perusal of F.I.R. itself and the seizure list, it appears that nothing has been recovered from the possession of this petitioner rather the alleged recovery has been made from the back of the house of the petitioner.
