The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 270, 272, 290, 291, 379 of the Indian Penal Code and 47(a) of the Excise Act.
On the information that the petitioner, one Sandeep Singh and Arun Rai are indulged in the business of illicit country made liquor, the police raided the hutment when 35 litres of spirit and liquor manufacturing equipments were recovered. The apprehended accused Ajay Kumar Rai suggested the name of the petitioner as a person escaped from the place of seizure.
Patna High Court Cr.Misc. No.7773 of 2015 (02) dt.26-02-2015 2/2 It is submitted by learned counsel for the petitioner that the recovery has not been made from the petitioner and only on suspicion the accusation has been levelled.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Paroo P.S. Case No. 203 of 2013 pending in the court of learned Chief Judicial Magistrate, Muzaffarpur.
With the aforesaid observation, this application is disposed of.
