This is second application which has been filed by learned counsel for the petitioner for modification of the order dated 31.08.2016, passed in Cr. Misc. No. 37950 of 2016, for extending a further period of three months for depositing the balance amount of Rs. 1,50,000/-.

Earlier the petitioner has also filed application vide Cr. Misc. No. 37950 of 2016 for modification of the order dated 02.05.2016, passed in Cr. Misc. No. 15506 of 2016 for extending a further period of four months for depositing the balance amount of Rs. 2,50,000/-, by which the petitioner was granted provisional anticipatory bail in connection with Samastipur(M) P.S. Case No.

Patna High Court Cr.Misc. No.55461 of 2016 (2) dt.23-12-2016 2/3 403 of 2014, pending in the court of learned S.D.J.M., Samastipur, and the petitioner was directed to deposit an amount of Rs. 4,00,000/- within a period of four months in the court below which shall be released in favour of the informant. The said modification application was disposed of and another four months time was extended for depositing the balance amount of Rs. 2,50,000/-.

It has been submitted on behalf of learned counsel for the petitioner that the petitioner has already deposited (Rs. 1,50,000+ Rs. 1,00,000/-) Total Rs. 2,50,000/- out of Rs. 4,00,000/- in compliance to the aforesaid order. He seeks further three months' time to deposit the balance amount of Rs.1,50,000/- The period of provisional anticipatory bail granted to the petitioner for depositing the balance amount is extended by another three months from the date of receipt/production of copy of the order. Within the said period, the petitioner shall deposit the balance amount of Rs. 1,50,000/-. Once, the balance amount is deposited within the stipulated period, the provisional bail granted to the petitioner shall be confirmed by the court below. The order dated 31.08.2016, passed in Cr. Misc. No. 37950 of 2016, stands modified to the extent as indicated above. The present modification application is, accordingly,
