Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek bail in connection with Dumariyaghat P.S. Case No. 207 of 2021 registered under Section 414 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 31.10.2021, charge-sheet has been submitted and are persons with clean antecedent and

Learned counsel for the petitioners submits that the petitioner no.1 is the driver and petitioner no.2 had taken lift. Learned counsel thus submits that neither the driver of the vehicle nor the passenger was aware what the owner had kept in the vehicle.

Learned APP opposes the bail application.

Considering the fact that the petitioners are in custody, charge-sheet has been submitted and are persons with clean antecedent, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.5,000/- (Rupees five thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IIcum-Special Judge, Motihari in connection with Dumariyaghat P.S. Case No. 207 of 2021.
