====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Gaunaha P. S. Case No. 120 of 2024 in a case registered for the offences punishable under Sections 8, 20(B)(ii)(C), 23(c), 25, 29 of the Narcotic Drugs and Psychotropic Substances Act and Section 317(5) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, 63.138 kg Ganja was recovered from the seized vehicle of which this petitioner is driver.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the

Patna High Court CR. MISC. No.65151 of 2025(3) dt.27-11-2025 2/2 aforesaid recovery. Petitioner is in custody since 08.09.2024.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the quantity of recovery and nature of accusation, prayer for bail of the petitioner is rejected.

7. However, since petitioner is in custody since 08.09.2024, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
