JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 This application, for grant of anticipatory bail, arises out of Dhansoi P.S. Case No. 147 of 2017, disclosing offences under Sections 498A/34 of the Indian Penal Code. Petitioner happens to be husband of the informant and allegation against the petitioner is of subjecting the informant to cruelty and torture with respect to non fulfillment of demand of one motorcycle as dowry and further she was also ousted from her matrimonial house.

Submission of learned counsel for the petitioner that he is still ready to keep the informant - wife with full honour and dignity and entire allegation is false and concocted and the marriage was solemnized ten years ago.

Patna High Court CR. MISC. No.58664 of 2019(2) dt.17-09-2019 2/2 Learned counsel for the State opposed the prayer of the petitioner and submitted that earlier the petitioner was given the benefit of Section 41(1) Cr.P.C. and was released on personal bond.

In such view of the matter, this application is disposed of with direction to the petitioner to surrender in the court below within two weeks from the date of receipt of this order, on which, the court below shall release him on provisional bail for a period of four months and, thereafter the learned court below shall issue notice to informant - opposite party no. 2 and on her appearance refer the matter to District Mediation Committee and direct both the parties to appear before the Mediation Committee for settlement of dispute between them and once the report of mediator is received, the court below being satisfied with the report as well as the conduct of the parties, will either confirm the provisional bail of the petitioner or will pass any order/orders as he deems fit and proper.
