The petitioner apprehends his arrest in connection with Siwan Muffasil P.S. Case no. 306 of 2016, registered under Section 409 of the Indian Penal Code.
The accusation is that in connection with Vigilance Inquiry regarding appointment of the Panchayat Teacher, Merit-list and Meeting Register of Panchayats were called for from all Panchyat Secretaries, but the aforesaid documents were not supplied by the petitioner, who was Panchayat Secretary of Bindusar Bujurg Panchayat.
Learned counsel for the petitioner submits that petitioner took the charge of Panchayat Secretary of bindusar Bujurg Panchyat in the light of the order dated 13.06.2012 of District Programme Officer,
Patna High Court Cr.Misc. No.55783 of 2016 (2) dt.17-01-2017 2/2 Siwan from Nandlal Ram, but Sri Nandlal Ram, the then Panchayat Secretary has not submitted the file and folder including the merit list and the meeting register regarding appointment of Panchayat teachers. On receiving the information to furnish the same by the higher officers, the petitioner sent a letter on 13.06.2015 with contention that the then Secretary, Nandlal Ram has not furnish any document regarding the appointment of Panchayat teacher in between the year 2006-12, which would appear from Annexure-2.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P.S. Case No.306 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
