JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2017 Petitioner is apprehending his arrest in connection with Gurua P.S. Case No. 117 of 2016 registered for the offences punishable under Sections punishable under Sections 147, 149, 341, 323, 325, 308, 337, 504 and 506 of the Indian Penal Code. It has been submitted on behalf of the petitioner that there is case and counter case between the parties and in the alleged occurrence, both sides have sustained injuries. It is alleged that the petitioner has assaulted the informant on his hand by means of lathi, but the injury is simple in nature.

Having heard both sides, in view of the fact that there is case and counter case between the parties and the injury caused to the informant was found to be simple in nature, let the petitioner,
Patna High Court Cr.Misc. No.413 of 2017 (2) dt.16-01-2017 2/2 above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri G.N. Dubey, learned Judicial Magistrate, Gaya, in connection with Gurua P.S. Case No. 117 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
