2. The petitioners apprehend their arrest in connection with Srinagar P.S. Case No. 161 of 2025 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. As per the first information report, a patrolling police team got a secret information that the petitioners had stored liquor in a hut near the pond. Accordingly, on search 13.5 liters of country made liquor was recovered and seized from the said hut.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have no criminal antecedents. The seized article does not belong to the petitioners. Only on the

Patna High Court CR. MISC. No.66070 of 2025(2) dt.24-09-2025 2/2 basis of a secret information, their names has surfaced in this case. The recovery has been made from an open place.

5. In view of the fact that the petitioners have no criminal antecedents and their name has surfaced on the basis of secret information and that the recovery was made from an open place, I am inclined to grant anticipatory bail to the petitioners.

6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge. Excise-II, Bettiah, West Champaran, in connection with Srinagar P.S. Case No. 161 of 2025 subject to the conditions as laid down under Section 482

(2) of the B.N.S.S., 2023.
