1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Mushahari P.S. Case no. 41 of 2022, registered under sections 307, 447, 341, 323, 324, 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and one another accused are said to have assaulted the informant and his wife.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No such occurrence as alleged in the FIR has taken place. Accepting the allegations for the sake of argument, the injury found on the informant is simple in nature. Co-accused Chandan Sahni has
Patna High Court CR. MISC. No.66347 of 2023(3) dt.13-12-2023 2/2 been enlarged on bail vide order dated 11.10.2023 passed in Cr. Misc. no. 64090 of 2023. The petitioner is in custody since 4.5.2023 and charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the nature of injury on the informant having been found to be simple in nature, grant of bail to co-accused Chandan Sahni and the petitioner having remained in custody since 4.5.2023, the petitioner is directed to be enlarged on bail in connection with Mushahari P.S. Case no. 41 of 2022, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class (East), Muzaffarpur.
