It is submitted that petitioner No. 6 namely Ravindra Das has been arrested, hence his anticipatory bail application has become infructuous.

Accordingly the application with regard to petitioner No. 6 namely Ravindra Das is disposed off. Petitioner Nos. 1 to 5 are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 307, 323, 324, 325, 341, 448 of the Indian Penal Code.

The accusation is of making assault to the

Patna High Court Cr.Misc. No.21883 of 2015 (2) dt.23-06-2015 2/2 informant and others.

It is submitted by learned counsel for the petitioners that there is counter version of the occurrence also and petitioners' side also received injuries. Subsequently the informant has retracted from the initial version and filed a petition to that effect before learned Court below. The same has been brought on record as Annexure-3.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, except petitioner No. 6, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Tekari P.S. Case No. 1 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
