JUSTICE ARUN KUMAR ORAL ORDER 21-08-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 341, 323, 504, 506/34 of the Indian Penal Code and Sections 25(I-B)A/26/35 of the Arms Act. Allegation in brief is that both the accused persons intercepted the informant on the way and Dharmendra put a pistol on his head and this petitioner, brother of Dharmendra intended to assault him with knife but seeing others coming there they escaped away then Dharmendra was apprehended by the local people. Learned counsel for the petitioner submits that the petitioner and informant are cousin. There is some family dispute, so this petitioner has falsely been implicated and he was not apprehended at the spot rather Dharmendra was apprehended and

Patna High Court Cr.Misc. No.38968 of 2017 (2) dt.21-08-2017 2/2 pistol was not recovered from possession of the petitioner and petitioner has got no criminal antecedent.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Jitendra Kumar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-cum-Sub Judge, 13th, Muzaffarpur in connection with Sakra P.S. Case No.161 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
