Versus

State of Bihar & Anr .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Pankaj Kumar For the Opposite Party/s : Mr. Parmeshwar Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-01-2017 Heard both sides.

The petitioner apprehends his arrest in Mahila P.S. case No. 32 of 2016 under Section 498A, 494/34 of the Indian Penal Code.

The learned counsel for the petitioner submits that informant after marriage left the house of petitioner in the year 2010 itself and she did not come to the house of petitioner. The petitioner solemnized second marriage thereafter the first wife filed this case. The petitioner never demanded any dowry nor tortured the wife rather petitioner was subjected to different sorts of torture by his first wife. The petitioner is still ready to keep his wife on any undertaking.

Considering the fact that petitioner has solemnized second marriage, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. BKS/- (Prabhat Kumar Jha, J) U T
