It is further submitted that till date the petitioner has not been suspended though he was not able to join his official duty on account of pendency of Madhepur P.S. Case No. 43 of 2016. It is further submitted that now the petitioner has been granted anticipatory bail in the said case. It is agreed between the parties that the present writ petition can be disposed of with a direction to the disciplinary authority to conclude the departmental proceeding and pass the

Patna High Court CWJC No.11229 of 2017(2) dt.23-02-2018 2/2 final order within a period of three months from today. It is further directed that in case no suspension order has been passed by the authority, the respondents would accept the joining of the petitioner for which the petitioner would appear before the concerned authority on 27.02.2018.
