2. The petitioner is seeking regular bail in connection with Excise(Prohibition) P.S. Case No. 1712 of 2024 for the offences punishable under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016 and Amendment Act, 2022.

3. As per prosecution case, there has been recovery of 120 liters of illicit liquor from a motorcycle and this petitioner was apprehended by the police on spot.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing has been recovered from his conscious possession and he has no concern

Patna High Court CR. MISC. No.66694 of 2024(2) dt.26-09-2024 2/2 with the alleged recovery of liquor. The petitioner is a person of clean antecedent. He is under custody since 21.07.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances of this case as well as petitioner having clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-3rd, Patna in connection with Excise(Prohibition) P.S. Case No. 1712 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
