Injured, Nandan Kumar Maurya gave his Fardbeyan at ICU, Oriana Hospital, Varanasi on 02.04.2019 disclosing therein that on 01.04.2019 at about 6:00 PM while he was proceeding ahead towards Tarachandi Dhaam and as soon as came Burhan Mor, he found four persons standing along with two motorcycles out of whom, he identified one of them as Sachchidanand Singh @ Bechan Singh, son-in-law of his uncle late Mahendra Singh. Three others having been claimed identified by him by face who fired causing injury over posterior aspect of left arm as well as entry wound on left humble region. It has further been alleged that on account of land dispute, Sachchidanand Singh @ Bechan Singh and Vishal

Patna High Court CR. MISC. No.59818 of 2019(3) dt.18-12-2019 2/2 @ Pappu (his cousin brother) had threatened of dire consequences at an earliest.

So the status of the petitioner happens to be that of abettor which is not at all found improved during course of investigation as is evident from the order impugned wherein there happens to be reference of the relevant paragraph of the case diary.

Further, as per para-3 of the instant petition, petitioner has got clean antecedent.

Accordingly, petitioner, VISHAL KUMAR @ PAPPU KUMAR @ VISHAL, in the event of arrest/surrender within four weeks from today, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram Darigaon PS Case No. 277 of 2019, subject to the condition as laid down under Section 438 (2) CrPC.
