This is a case registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.
The allegation in the FIR is that one country made pistol and live cartridge are said to have been recovered from the possession of the petitioner. Further allegation in the FIR is with respect to recovery of Apache Motorcycle from the petitioner. Counsel for the petitioner submits that during investigation the said Apache Motorcyle was found to be of his father. He is in custody in connection with instant case since 01.04.2017. He further submits that though there are other cases pending before the present case, details of which he has disclosed in para 3 of the petition, but he is on bail. Patna High Court Cr.Misc. No.39271 of 2017 (2) dt.19-08-2017 2/2 made has been granted bail vide order dated 13.07.2017 passed in bail petition no. 345 of 2017 by the Sessions Judge, Buxar. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in Nagar (Buxar) P.S. Case No. 150 of 2017.
