JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.

The prosecution case is that on 26.11.2011, the informant came to know through his ten years old son that his wife has been killed by the accused persons since the victim saw this petitioner establishing illicit relationship with one Ashok Kumar Singh.

It is submitted by learned counsel for the petitioner that after investigation, the accusation was found false and final form was submitted but differing with the final form, the cognizance was taken.

Considering the nature of accusation, this Court is not

Patna High Court Cr.Misc. No.24761 of 2015 (2) dt.08-07-2015 2/2 inclined to grant anticipatory bail to the petitioner. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if she surrenders within a period of six weeks in connection with Noorsarai P.S. Case No. 154 of 2011 pending in the court of learned CJM, Nalanda at Biharsharif keeping in view that the petitioner is a lady and during investigation, the accusation was not found true. Accordingly, the application is disposed of.
