1. Heard learned counsel for the petitioner and Mr. Sunil Kumar Pandey, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner at the outset very fairly submits that after filing of the instant anticipatory bail application, notice under Section 41A of the Cr.P.C. was issued to the petitioner, as such, for the present, the petitioner does not apprehend arrest, thus, seeks permission to withdraw the prayer for anticipatory bail with liberty to file afresh, if need arises.
