The petitioner seeks pre-arrest bail in connection with Sasaram Darigaon P.S. Case No. 277 of 2019 registered under Sections 341, 506, 307, 120-B of the Indian Penal Code and 27 of the Arms Act.
It is contended by the learned counsel for the petitioner that though the petitioner is named in the FIR, there is no allegation against him that he participated in the commission of the crime in any manner. The specific allegation in the FIR is against an unknown person. The informant has categorically stated that the petitioner happens to be the son-in-law of his uncle. As a matter of fact, the petitioner has been named due to land dispute going on between the informant and his family
Patna High Court CR. MISC. No.59349 of 2019(3) dt.20-11-2019 2/2 members and his father-in-law. It is further contended that the petitioner has got no criminal antecedent.
Learned counsel for the State has opposed the application for grant of pre-arrest bail of the petitioner. He has contended that a person accompanying the petitioner is alleged to have opened fire causing injury to the informant. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram Darigaon P.S. Case No. 277 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
