This is an application for bail in connection with Bithan P.S.Case No. 16 of 2014 registered for the offences punishable under Sections 302, 385/34 of the Indian Penal Code and 27 of the Arms Act.
It has been submitted on behalf of the petitioner that there is no specific allegation of firing against the petitioner and, as a matter of fact, there was enmity between the deceased and one co-accused Jitendra Mahto and the deceased was made accused in a case relating to murder of Jitendra Mahto and petitioner is in custody since 20.8.2016.
Heard learned APP also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.2896 of 2017 (3) dt.29-03-2017 2/2 Having heard both sides and from perusal of FIR it appears that deceased has named this petitioner although no specific overt act has been alleged against him, as such, I am not inclined to grant bail to the petitioner.
However, since the petitioner is in custody learned trial court is directed to expedite the trial of the petitioner. Accordingly, this application is dismissed.
