The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 379, 34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that the petitioner no.1 took possession of the informant's land on which he sowed maize, the accused persons threatened to cut the maize crop of the informant. The accused persons also abused the informant by calling caste name and snatched Rs.6500/-.
It is submitted by learned counsel for the petitioners that the land in dispute is purchased land of the petitioner and
Patna High Court Cr.Misc. No.21214 of 2015 (2) dt.19-05-2015 2/2 there is counter version of the occurrence also. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 47 of 2015, pending before the learned Chief Judicial Magistrate, Saharsa.
With the above observation, this application is, accordingly, disposed off.
