JUSTICE SANJAY PRIYA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case registered under Sections 323, 341, 307 and 34 of the Indian Penal Code.

It is alleged that on the date of occurrence petitioner along with her husband assaulted the informant with bamboo and lathi leveling the allegation that he has stolen the Chappals. Doctor has found fracture in right temporal bone caused by hard blunt substance.

It has been submitted that the petitioner is a lady and no overt act has been alleged against her.

Keeping in view of the fact that the petitioner is a lady and no overt act has been alleged against her, let the above named petitioner, in the event of her arrest/surrender in the court

Patna High Court Cr.Misc. No.1437 of 2017 (2) dt.17-01-2017 2/2 below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ranjit Prasad, learned Judicial Magistrate, Danapur, District- Patna in Sigauri P.S.Case No.29 of 2016,subject to the conditions as laid down u/s 438(2) Cr.P.C.
