The petitioner seeks pre-arrest bail in connection with Maharajganj P.S. Case No. 107 of 2019 registered under Sections 413, 414 and 34 of the Indian Penal Code.

The accusation is that on receiving secret information about keeping of theft Bolero vehicle, bearing registration no. BR-07PB-7288 by Ajay Kumar Yadav, son of Jai Shankar Yadav, in village Vapia, the informant, along with other police personnel, reached there and found said vehicle parked near the house of Ajay Kumar Yadav, son of Jai Shankar Yadav. Jai Shankar Yadav. On query, Jai Shankar Yadav disclosed that vehicle is purchased by his son, Ajay Kumar Yadav, from Parshuram Singh (petitioner), but, he did not produce any paper. Thereafter, the informant, along with other police personnel, reached at village Katwar where one Sonalika tractor was found, but, Parshuram Singh was not at his shop the persons present there disclosed that the tractor is of Parshuram Singh (petitioner), who used to sell the theft

Patna High Court CR. MISC. No.62505 of 2019(2) dt.17-10-2019 2/2 vehicle. Thereafter, both the vehicles were carried at Police Station. The learned counsel appearing on behalf of the petitioner submits that while it is alleged that one tractor seized by the informant in front of the shop of the petitioner, but, the seizure list, itself, indicates that the said tractor was seized from the campus of Police Station Maharajganj, which indicates about the false implication of the petitioner. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Maharajganj P.S. Case No. 107 of 2019 shall be released on bail on furnishing bail bond of Rs.

10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, V, Siwan, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
