JUSTICE DR. ANSHUMAN ORAL ORDER 03-12-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the Director of Revenue Intelligence.
2. Learned counsel for the petitioner submits that the petitioner's earlier application for bail was rejected vide order dated 25.09.2024 passed in Criminal Miscellaneous No. 41727 of 2024. The petitioner has been in custody since 30.12.2023. It is further submitted that two co-accused persons have already been granted bail subject to certain conditions, whereas the petitioner's prayer for bail was declined. Learned counsel contends that the petitioner is willing to comply with any
Patna High Court CR. MISC. No.64253 of 2025(3) dt.03-12-2025 2/2 condition that may be imposed by this Hon'ble Court.
3. Learned counsel for the State opposes the prayer for bail.
4. Learned counsel for the D.R.I. submits that the recovery of ganja admeasuring 75.98 KG has been made from the petitioner's possession which is commercial quantity.
5. In the present facts and circumstances, I am not inclined to grant bail to the petitioner.
6. Accordingly, the prayer for bail of the petitioner in connection with D.R.I. Muzaffarpur Case No. 11 of 2023-24, NDPS Case No. 96/2024, pending before the learned Special Judge Exclusive Special Court-1, NDPS, Muzaffarpur is hereby rejected.
7. However, the trial Court is directed to concluded the trial as expeditiously as possible.
