JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-09-2019 The present writ petition has been filed for directing the respondents to remove the encroachment made by the private respondents over the public land/Rasta situated in villageBhabrua @ Bhairwa, Thana No. 82, Khata No. 231, Khesra No. 894, Anchal-Madhuban, District-East Champaran. In case the petitioner is seeking removal of encroachment made over the public land, he is required to approach the Circle Officer, Madhuban, District-East Champaran under the provisions of the Bihar Public Land Encroachment Act,

Patna High Court CWJC No.18188 of 2019(2) dt.12-09-2019 2/2 1956 (hereinafter referred to as the 'Act, 1956') for redressal of his grievances.

Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with liberty to the petitioner to approach the Circle Officer, Madhuban, District-East Champaran by filing appropriate complaint under the provisions of the Act, 1956 and in case such an application/complaint is filed, the Circle Officer, Madhuban, District-East Champaran shall take appropriate action in accordance with the provisions of the Act, 1956. The writ petition stands disposed off on the aforesaid terms.
