The petitioner apprehends arrest in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code and sections 25(1-B)a, 26, 27 and 35 of the Arms Act. .
Learned counsel for the petitioner submits that at best the petitioner can be said to be order giver and allegation of assault is against other accused persons. There is a case and counter case. Admittedly there is land dispute between the parties. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. No.2091 of 2022(2) dt.25-07-2022 2/2 within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram Mufassil Police Station Case No. 288 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
