JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Patahi P.S. Case No. 25 of 2012 registered under Section 379 of the Indian Penal Code. As per the prosecution case, Mahindra tractor of the informant is said to have been stolen by some unknown miscreants.

It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. Nothing incriminating article has been recovered from his conscious physical possession. His name has come in the confessional staement of co-accused persons, namely, Shambhu Sah and Suresh Sah recorded in Piprakothi P.S. Case No.53 of 2017 and they have been granted bail in that case by this

Patna High Court Cr.Misc. No.38105 of 2017 (02) dt.10-08-2017 2/2 Court. The petitioner has been languishing in custody since 01.05.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 8thAdditional Chief Judicial Magistrate, East Champaran at Motihari in connection with Patahi P.S.
