The petitioner apprehends his arrest in connection with Cheriya Bariyarpur P.S. Case No.127 of 2022, registered for the offences punishable under Sections 147, 149, 341, 323, 354(B), 337 and 504 of the Indian Penal Code. As per FIR, the allegation against the petitioner is that he alongwith others assaulted the informant by holding her hair. Further allegation against the petitioner is that he assaulted the informant by means of bricks on her waist and back, so the informant fell down and the petitioner pulled her saree. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.65590 of 2022(3) dt.10-04-2023 2/2 present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that there is case and counter case between the parties and both sides sustained injuries. It is submitted that there is admitted land dispute between the parties. It is also submitted that the injuries sustained by the injured persons are simple in nature.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Cheriya Bariyarpur P.S. Case No.127 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
