JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 23.2.2016 in a case registered for the offences punishable under Sections 498A, 494,341,323, 325,308,504 and 506 of the Indian Penal Code. The basic accusation is of torture and performance of second marriage.

It is submitted by the learned counsel for the petitioner that the petitioner has not performed second marriage and is ready to keep the informant as wife with full dignity and honour. The petitioner has also filed Matrimonial Case No. 50 of 2016 for

Patna High Court Cr.Misc. No.18788 of 2016 (2) dt.29-04-2016 2/2 restitution of conjugal rights.

Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Sahodra P.S. Case No. 19 of 2016.
