JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-05-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner seeks bail in a case for the offences punishable under sections 25(1-AA) 26, 35 of the Arms Act. Allegedly, the petitioner and other co-accused were apprehended and from possession of the petitioner, one mobile was recovered. The petitioner is in custody since 1.1.2015. Other co-accused Ram Dayal Yadav has been allowed bail vide Cr. Misc. No.19732 of 2015 by another Co-ordinate Bench of this Court.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs.10,000/- (ten thousand) with two

No.22181 of 2016 (2) dt.23-05-2016 2/2 sureties of the like amount each to the satisfaction of Sri Devesh Kumar, Judicial Magistrate, 1st Class, Jhanjharpur, District Madhubani in connection with Khutauna P.S. Case No.2 of 2015, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
