====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Saraiya P.S. Case No. 40 of 2016, registered for the offence punishable under Sections 414 of the Indian Penal Code. The case of the prosecution is that while the police was conducting checking, the petitioner was stopped and when the papers pertaining to his motorcycle were demanded, he refused to produce the same and started fleeing away, whereafter he was apprehended by the police.

The learned counsel for the petitioner submits that the petitioner has a clean antecedent barring one case in which he has already been granted bail and is in custody since 08.02.2016, hence the petitioner has suitably been punished by way of long incarceration.

Patna High Court Cr.Misc. No.37910 of 2017 (2) dt.10-08-2017 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur in connection with Saraiya P.S. Case No. 40 of 2016.
