JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is apprehending his arrest in connection with Khajouli P.S. Case No. 103 of 2013 for the offences instituted under Sections 341, 323, 498(A), 504/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant was married with the petitioner and after marriage, the accused persons demanded dowry and when the same was not fulfilled, they tortured her by different ways and also ousted from the house after taking her belongings.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.27167 of 2015 (2) dt.21-07-2015 2/2 informant is residing along with the petitioner. It is directed that the petitioner and the informant shall appear before the court below and the court below will satisfy whether the petitioner and the informant are residing together or not.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Khajouli P.S. Case No. 103 of 2013 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Basant Kumar, Judicial Magistrate 1st class, Madhubani, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
