The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273 and 414 of the Indian Penal Code and sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on the vehicle in question being searched, it is stated that a total of 2214 litres of liquor was recovered. The truck belonged to one Barindra Singh. It is further stated that five accused persons including the petitioner herein managed to flee away.
It is submitted by learned counsel for the petitioner that the petitioner was neither arrested at the spot nor any incriminating article recovered from his possession. He has no concern with the seized truck or the liquor in question. The
Patna High Court CR. MISC. No.1673 of 2022(2) dt.09-06-2022 2/2 cause of his false implication is his antecedent. He is in custody since 25.10.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the petitioner not having been arrested at the spot, his having remained in custody for 7 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Sahebganj P.S. Case no.88 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
