2. The petitioners are seeking regular bail in connection with Rajnagar P.S. Case No. 304 of 2024, registered for the offences punishable under Sections 274, 275, 3(5) of the BNS and Sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act.

3. As per allegation, 270 of illicit Nepali liquor was recovered from a vehicle in which the petitioner was travelling with other co-accused persons. The petitioners were arrested at the spot.

4. The learned counsel for the petitioners has submitted that petitioners are innocent and have falsely been

Patna High Court CR. MISC. No.68523 of 2024(2) dt.07-10-2024 2/2 implicated in this case. Nothing has been recovered from their conscious possession. Their names have figured merely on the basis of suspicion. They are the persons of clean antecedent and are under custody since 10.08.2024.

5. Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Madhubani in connection with Rajnagar P.S. Case No. 304 of 2024, subject to the condition:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
