ANJANA MISHRA ORAL ORDER 21-07-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Kotwa P.S. Case No.70 of 2015 for allegedly having committed the offences under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners and the informants are close neighbours and due to some disputes with regard to advancement of loan between them, the present occurrence has taken place. The injury is simple in nature and there is no repetition of blows so as to attract the provisions of Section 307 of the Indian Penal Code.

No.27431 of 2015 (2) dt.21-07-2015 2/2 Considering the nature of allegations and the fact that the injury is simple in nature and also the fact that the petitioners have no criminal antecedents, let both the above named petitioners, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar IV, J.M. 1st Class Sadar Motihari, East Champaran, in connection with Kotwa P.S. Case No.70 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
