The petitioner seeks bail in connection with S.T. No. 249/ 2021 arising out of Jhajha P.S. Case No. 336 of 2020 registered for the offences punishable under Sections 394 and 307 of the Indian Penal Code read with Section 27 of the Arms Act and later on, Section 394 of the IPC was deleted and Section 397 of the IPC was added vide order dated 29.09.2020. The learned counsel for the petitioner submits that the petitioner is in custody since 14.12.2020, charge-sheet has been submitted in the case and has antecedent of one case and the informant alleges that she along with her brother (injured) were intercepted by six unknown criminals who looted Rs. 2500/- and
Patna High Court CR. MISC. No.1632 of 2022(2) dt.24-05-2022 2/3 mobile of the informant and fired causing two injuries on left hand of her brother.
The learned counsel submits that the FIR was against unknown and the petitioner was arrested in Jhajha P.S. Case No. 337 of 2020 where he was made to confess his participation in the present occurrence, it is next submitted that confessional statement made in police custody does not have any evidentiary value. It is next submitted that petitioner was not put on TIP nor any incriminating article was recovered from his possession to connect him with the offence, it is also submitted that coaccused Mithilesh Kumar has been granted bail by order dated 06.12.2021 in Cr. Misc. No. 22494 of 2021.
The learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 14.12.2020, charge-sheet has been submitted in the case and was not put on TIP nor any incriminating article was recovered from his possession and co-accused has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor
