The petitioner seeks bail in a case registered for offences under Sections 30 (a) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 261 litres of foreign liquor were allegedly recovered from the behind of the house of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 16.05.2017. Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.39892 of 2017(2) dt.25-08-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Excise Case No. 70 of 2017 (P.R. No. 05 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
