JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 392, 395 of the Indian Penal Code.
The informant alleges that two unknown criminals on the point of pistol have looted away the motorcycle, cash, gold ornaments and other articles of the informant.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The F.I.R has been lodged
Patna High Court CR. MISC. No.62160 of 2022(2) dt.21-02-2023 2/2 against unknown. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner sprang up on the confessional statement of co-accused Sanjay Kumar Paswan and except confession, nothing has come against the petitioner. No T.I.P has been held till date. The petitioner is languishing in custody since 30.09.2021.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Hajipur Sadar P.S. Case No. 427 of 2021.
