The petitioner apprehends his arrest in a case registered for the offence under Sections 304(B), 201, 34 of the Indian Penal Code.

It is a case of 'dowry death'.

Petitioner is cousin father-in-law of the deceased (daughter of the informant). The allegation of torture and demand of dowry is general and omnibus. Petitioner is separate in mess & property and has got no concern with the affairs of deceased and her husband. Learned counsel for the petitioner further submits that during trial in Sessions Trial No. 609 of 2021 (Annexure - 3), the informant was examined and he did not support the prosecution case. He stated that the deceased died due to abdominal disease and in spite of best effort, she could not be saved.

No.62368 of 2022(2) dt.11-04-2023 2/2 Considering the fact that petitioner is cousin father-inlaw of deceased and during trial, the informant has not supported the prosecution case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Chapra, Saran in connection with Derni P.S. Case No. 84 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
