The petitioner apprehends his arrest in connection with Belhar P.S. Case no. 199 of 2019, registered under Section 7 of the E.C. Act.
The accusation is of recovery of 626 plastic bags, each containing 50 Kg. on truck parked in front of Shiv Guru Rice Mill and 202 plastic bags, each containing 50 Kg of rice in the premises of M/s Shiv Guru Rice Mill. On some bags monogram of Bihar State Food and Civil Supplies Corporation were printed.
Learned counsel for the petitioner submits that, in fact, petitioner is the proprietor of Shiv Guru Rice Mill and after husking the paddy, rice was packet in several plastic bags
Patna High Court CR. MISC. No.59255 of 2019(2) dt.23-09-2019 2/2 purchased from the market, which is easily available in the market.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Banka in connection with Belhar P.S. Case No. 199 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
