Heard both parties.
Learned counsel for the petitioner submitted that vide order dated 14.06.2016 passed in Cr.W.J.C. no.571/2016, this court directed the Superintendent of Police, Muzaffarpur to provide a suitable and proper security to the petitioner as well as her husband and children from 26.06.2016 to 26.09.2016 on the payment of cost and in pursuance of the aforesaid order, only one body guard was provided to the petitioner as well as her family members after charging more than rupees one lakh. It is further submitted that the petitioner along with her husband and others accompanied by the said body guard went to her matrimonial home but her in-laws as well as villagers created nuisance and stopped the petitioner as well as her husband and children from entering into her matrimonial home and also became
Patna High Court MJC No.2411 of 2016 (4) dt.17-08-2016 furious but the concerned body guard instead of protecting the petitioner as well as her family members fled away from there leaving the petitioner as well as her family members and, therefore, the aforesaid circumstance, clearly goes to show that Senior Superintendent of Police, Muzaffarpur has not complied with the direction of this court in its true sprit rather he did only formality. On the other hand, learned counsel appearing for the State refuted the above stated submissions submitting that the petitioner wants to settle her family dispute inguise of seeking security and, as a matter of fact, she wants to have forcible entry into her matrimonial home taking advantage of direction of this court. It is further submitted by him that State had already provided body guard to the petitioner as well as her family members and the State is ready to protect the life of the petitioner as well as her family members but police officials can not indulge themselves into the private dispute of the petitioner as well as her in-laws.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this contempt petition stands deposed of. However, opposite parties, particularly, Superintendent of Police, Muzaffarpur shall ensure the protection of the life of the petitioner as well as her family members as per direction given by this court in Cr.W.J.C. no.571/2016.
