The petitioner has renewed his prayer for grant of bail in a case registered under section 302 and other sections of the Indian Penal Code.

The earlier application for bail of the petitioner was rejected vide order dated 2.3.2022 passed in Cr. Misc. no.39844 of 2021.

As per the prosecution case, the four named accused persons including the petitioner herein are said to have assaulted the father of the informant leading to his death. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 2.3.2022 giving liberty to the petitioner to renew his

Patna High Court CR. MISC. No.62287 of 2022(2) dt.23-11-2022 2/2 prayer for bail after framing of charge. Referring to the order as contained in Annexure-3 to the petition, it is submitted that charge against the petitioner had already been framed on 20.1.2021. The petitioner is in custody since 16.7.2020 and undertakes to cooperate in the trial.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the liberty granted in the earlier order of rejection dated 2.3.2022 and charge having already been framed against the petitioner, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.463 of 2020 (arising out of Panapur P.S. Case no.101 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge V, Saran at Chapra.
