The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The father of the deceased alleged that while his son was going to market all the accused persons including the petitioner caught his son Mukesh Kumar Ram and the petitioner slit his neck causing death of Mukesh Kumar Ram on the spot. Learned counsel for the petitioner submits that during course of investigation, some of the witnesses have given different version stating that the deceased was of bad character and he was found with the wife of the petitioner in a lonely place and that is why the occurrence took place in a spur of moment.

No.31218 of 2015 (5) dt.15-12-2015 2/2 From perusal of the records, it appears that the informant who happens to be an eye witness of the occurrence has very categorically stated that the petitioner and others caught his son and the petitioner slit the neck of the deceased Mukesh Kumar Ram causing his death on the spot. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) KKSINHA/- U T
