JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in Patliputra P.S.Case No.112/17 for the offence under Sections 379/411 of the Indian Penal Code.

The petitioner is said to have been apprehended in the Basundhara Apartment along with the motor cycle of the informant stealing it away.

It is submitted by the learned counsel for the petitioner that though the petitioner is said to have been apprehended in Basundhara Apartment but the seizure list indicates that the petitioner was not apprehended at Basundhara Apartment rather at the Dayanand Complex, Nehru Nagar, i.e., at the place of the residence of the informant. The seizure list does not bear signature

Patna High Court Cr.Misc. No.39529 of 2017 (2) dt.19-08-2017 2/2 of the petitioner. As a matter of fact, the alleged motor cycle was not recovered from the possession of the petitioner and he has been falsely implicated in this case. He is in custody since 6.4.2017.

In view of the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sub Judge-XII - cum - A.C.J.M., Patna, in Patliputra P.S.Case No.112/17.
