The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 402 and other ancillary sections of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act. .

As per the prosecution case, one country made pistol, 3 live cartridges and 1 mobile phone and cash Rs.5500/- were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Cash and mobile phone belong to the petitioner. He is in custody since 16.8.2021.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Bhojpur at Ara in Ara Nagar Police Station Case No. 557 of 2021.
