JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,323,354A,448,379,504 and 506 of the Indian Penal Code and sections 3 and 4 of The Prevention Witch (daain) Practices Act, 1999.

The prosecution case is that the accused persons entered into the courtyard of the informant, dragged her by catching hair locks when son and daughters of the informant came to rescue they were also assaulted. The informant was abused by calling witch and the

Patna High Court Cr.Misc. No.31314 of 2015 (2) dt.04-08-2015 2/2 accused persons took away rupees five thousand and also damaged the house.

It is submitted by the learned counsel for the petitioners that simply for the wages dispute the accusation has been levelled and there is counter version of the occurrence as the petitioners side lodged Complaint Case No. 1148C of 2015 on 11.5.2015. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the accusation being omnibus and genera against several persons and the petitioners having no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Araria in connection with Kursakanta P.S. Case No. 55 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
