Heard learned counsel for the petitioners and learned A.P.P. for the State, Sri Rabindra Kumar. 2.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 115(2), 117(2), 303(3), 118(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the prosecution story as alleged by the informant is that the informant on 26-5-2025 at 6 pm was going towards his house from his hotel where he met the petitioners near his house who used to live in his house on rent and had vacated the house

No.63743 of 2025(2) dt.23-09-2025 2/3 without paying the arrears of rent, hence the informant demanded his outstanding rent of Rs. 3,500/-, when it is alleged that the petitioners assaulted the informant by iron rod and lathi causing injury on head and also snatched his golden chain and Rs. 5,000 in cash.

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to rent, the occurrence is alleged to have taken place. It is also submitted that the date of occurrence is 26-5-2025 and the FIR was sent to the court on 30-5-2025, i.e., after a delay of four days, which casts an aspersion on the case of the prosecution. It is also submitted that even presuming what has been alleged is true without admitting then the injury suffered by the injured is simple in nature and petitioners are not criminals.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court
Patna High Court CR. MISC. No.63743 of 2025(2) dt.23-09-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mokama P.S. Case No. 218 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
