The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 120B of the Indian Penal Code and Sections 30 (a), 38 and 47 of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 360 litres of country-made liquor were allegedly recovered from the Bolero vehicle which was being boarded by two persons including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 01.07.2017. Considering the facts and the circumstances of

No.40404 of 2017(2) dt.25-08-2017 2/2 the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Gaya in connection with Barachatti P.S. Case No. 385 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
