JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 18-06-2018 Matter pertains to transfer of the petitioner and challenge is made to an order dated 27.7.2017 passed in C.W.J.C. No.17460 of 2016. The transfer in question was effected on 16.9.2016 and, for various reasons indicated in the impugned order, the learned Writ Court has found the transfer to be unsustainable in law.
Patna High Court LPA No.371 of 2018 dt.18-06-2018 2/2 Now from the counter affidavit filed by the respondent employee we find that the transfer order in question has been cancelled. The original petitioner has been permitted to join on the original place of posting and, therefore, in the facts and circumstances of the case, now no further indulgence is called for in the matter for the present. The application stands disposed of. The legal questions and other issues raised in the appeal are left open to be considered in an appropriate case.
